AKRONE COMMERCIAL WARRANTY AGREEMENT

Applicable Version

This commercial warranty agreement applies to AKRONE watches, hereinafter referred to as the “Product”, ordered from the date of online publication of this version, August 17, 2026, and benefiting from the AKRONE commercial warranty.

Products ordered prior to this date remain subject to the warranty conditions and commercial commitments applicable at the time of their acquisition, subject to mandatory legal provisions.

The publication or modification of this agreement cannot retroactively reduce or eliminate a right or benefit previously granted.

Where a commercial warranty or advertisement applicable at the time of acquisition provided for more favorable conditions, these remain applicable under the conditions provided for by the regulations.

1. AKRONE COMMERCIAL WARRANTY

1.1 Guarantor

The AKRONE commercial warranty is granted free of charge, without additional cost.

It complements the legal warranties enjoyed by the consumer and does not replace, reduce or limit them.

This commercial warranty agreement is sent to the consumer by e-mail, in a legible and understandable manner, at the latest at the time of delivery of the Product.

1.2 Duration

AKRONE watches benefiting from this commercial warranty are covered for an additional period of twelve (12) months, corresponding to the period between the twenty-fifth and thirty-sixth month following the delivery of the Product.

This warranty covers both watches equipped with a mechanical movement and those equipped with a quartz movement.

The warranty certificate is issued on the date of delivery of the Product. This date determines the applicable warranty period.

When a legal warranty continues to be effective beyond the twenty-fourth month, particularly due to a suspension or extension provided by law, it remains applicable regardless of the AKRONE commercial warranty.

1.3 Territorial Scope

The AKRONE commercial warranty is valid worldwide, regardless of the country in which its beneficiary is located.

This coverage remains subject to legal or regulatory restrictions, international sanctions, customs rules or export control measures that may make shipment or intervention impossible.

The terms relating to transport costs are specified in article 5.

1.4 Test, Press, Demonstration and Donation Products

Unless otherwise expressly agreed in writing by AKRONE or in an applicable advertisement, the commercial warranty provided for in this agreement is not granted to prototypes, loaned watches, demonstration models, press copies, test products, donations or other Products given without a sale entitling them to this commercial warranty.

The subsequent resale of such a Product does not create an AKRONE commercial warranty that had not been granted at its initial delivery.

These provisions are without prejudice to any mandatory rights that may be applicable depending on the legal nature of the operation concerned.

2. COVERAGE AND EXCLUSIONS OF THE COMMERCIAL WARRANTY

During its period of application, the AKRONE commercial warranty covers defects in materials or manufacturing affecting the proper functioning of the watch under normal conditions of use.

When a covered defect is found, AKRONE will repair the watch free of charge.

When repair is impossible or disproportionate, particularly due to the definitive unavailability of a component, AKRONE may replace the watch with an identical model or, if it is no longer available, with a model having equivalent or comparable characteristics.

The availability of spare parts may be limited in time.

2.1 General Exclusions

The AKRONE commercial warranty does not cover damage or failures resulting from:

  • normal wear and tear or aging of the watch or its components;
  • incorrect, abusive or non-compliant use with the Product's characteristics;
  • a fall, impact, crushing, breakage or accident;
  • immersion or exposure to water beyond the waterproofing limits announced for the model;
  • lack of maintenance when it is the cause of the observed damage;
  • non-compliance with maintenance recommendations or water-resistance checks when it is the cause of the observed damage;
  • exposure to magnetic fields exceeding the tolerances announced for the model;
  • unauthorized modification, customization or intervention under the conditions specified below;
  • an external event or a case of force majeure not originating from a defect in the watch;
  • theft or loss of the watch.

Intervention by a third party

Any unauthorized intervention involving in particular the opening of the case, manipulation of the movement, the electronic system, the sealing components or any other internal component may lead to the exclusion of the commercial warranty for defects, breakdowns or damage likely to have been caused or aggravated by this intervention.

AKRONE may also refuse coverage under the commercial warranty when, based on the technical observations made on the Product, an intervention carried out by a third party has altered its integrity or makes it impossible to reliably establish the origin of the alleged defect.

An external intervention without impact on the functioning or technical integrity of the watch does not, in itself, constitute a reason for exclusion.

These provisions concern exclusively the AKRONE commercial warranty and cannot have the effect of eliminating or reducing legal warranties when they are applicable.

2.2 Quartz Model Battery

The battery equipping a quartz movement watch is a consumable item intended to be replaced periodically.

Its lifespan may vary depending on the movement, the watch's functions, their frequency of use, usage conditions and environmental conditions.

Consequently, normal battery wear, its depletion, its normal autonomy, its periodic replacement as well as the costs corresponding to this replacement are not covered by the AKRONE commercial warranty, including during the period between the twenty-fifth and thirty-sixth month following delivery.

The mere fact that a battery must be replaced during the life of the watch does not, therefore, in itself constitute a manufacturing defect of the watch.

This exclusion does not apply when abnormally rapid consumption or a failure results from a manufacturing defect of the watch, its movement or its power system covered by an applicable warranty.

It does not deprive the consumer of their rights under legal warranties when they are applicable.

2.3 Straps and Accessories

Straps and accessories, particularly in leather, textile, nylon or rubber, are subject to normal wear resulting in particular from daily wear, friction, perspiration, humidity, water, UV rays, temperature variations and the natural aging of materials.

This normal wear and tear, as well as their routine replacement, are not covered by the commercial warranty.

A manufacturing defect remains covered when it falls within the scope of an applicable warranty.

2.4 Water Resistance

The water resistance of a watch depends in particular on the condition of its seals and its conditions of use.

AKRONE recommends regular water resistance checks and, when the use of the watch justifies it, an annual check.

Infiltration resulting from use exceeding the announced water resistance level or from an identified lack of maintenance is not covered by the commercial warranty.

This exclusion does not apply when infiltration results from a defect covered by an applicable warranty.

2.5 Movement Precision

The precision tolerances specific to each movement are indicated in the technical characteristics of the model.

A drift within the announced tolerances does not, in itself, constitute a defect covered by the commercial warranty.

Shocks, magnetic fields or other external factors can affect the precision of a movement without necessarily resulting from a manufacturing defect.

3. LEGAL WARRANTIES

The AKRONE commercial warranty applies without prejudice to the legal warranty of conformity provided for in articles L.217-1 to L.217-32 of the Consumer Code and the warranty relating to hidden defects provided for in articles 1641 to 1649 of the Civil Code.

BOX – LEGAL WARRANTIES

The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal warranty of conformity in the event of a lack of conformity appearing. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.

When the sales contract for the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal warranty is applicable to this digital content or digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date of its appearance.

The legal warranty of conformity entails an obligation for the professional, if applicable, to provide all necessary updates to maintain the conformity of the goods.

The legal warranty of conformity gives the consumer the right to repair or replace the goods within thirty days following their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.

If the consumer requests the repair of the goods, but the seller imposes replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by being fully reimbursed against return of the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the goods occurs after a period of thirty days;

3° The repair or replacement of the goods causes significant inconvenience to the consumer, particularly when the consumer permanently bears the costs of collecting or removing the non-compliant goods, or if they bear the costs of installing the repaired or replacement goods;

4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer also has the right to a reduction in the price of the goods or to the termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or contract termination. The consumer is then not obliged to request repair or replacement of the goods beforehand.

The consumer does not have the right to terminate the sale if the lack of conformity is minor.

Any period during which the goods are immobilized for repair or replacement suspends the warranty period that remained to run until the delivery of the repaired goods.

The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.

A seller who maliciously obstructs the implementation of the legal warranty of conformity incurs a civil fine of a maximum of 300,000 euros, which can be increased to up to 10% of the average annual turnover (article L. 241-5 of the Consumer Code).

The consumer also benefits from the legal warranty against hidden defects in application of articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This warranty gives the right to a price reduction if the goods are kept or to a full refund against return of the goods.

4. IMPLEMENTATION OF THE WARRANTY

AKRONE may request reasonably necessary information to identify the watch, its acquisition, and the alleged defect, including:

  • the order number or any information allowing identification of the initial purchase;
  • available proof of purchase;
  • the warranty certificate or card when issued;
  • the watch's serial number;
  • a description of the problem observed;
  • photographs or videos when they can facilitate diagnosis.

The loss of a document does not automatically deprive the beneficiary of the warranty when AKRONE can reasonably identify the Product and verify its eligibility by other means.

In the event of resale, AKRONE may request reasonably necessary information to identify the Product, its initial acquisition, and the transfer of ownership.

AKRONE will communicate return instructions to the beneficiary before any shipment.

5. TRANSPORT, DELAYS AND IMMOBILIZATION

5.1 Transport Costs Under Commercial Warranty

When the intervention falls under the AKRONE commercial warranty, AKRONE covers the return costs up to the cost that would have been incurred for a standard return from the country or initial delivery zone of the Product.

When the beneficiary is in a different country or territory than that of the initial delivery, any additional costs directly related to this new location, particularly additional international shipping costs, repatriation costs, or customs formalities, may remain at their expense.

AKRONE informs the beneficiary of the applicable terms before shipment.

These terms exclusively concern the AKRONE commercial warranty and do not limit the mandatory rules applicable to the legal warranty of conformity, which is implemented free of charge for the consumer.

5.2 Processing Times

For interventions falling exclusively under the AKRONE commercial warranty or an after-sales service not covered by the legal warranty of conformity, an average period of nine (9) to fifteen (15) weeks may be necessary, particularly when a complete overhaul, a complex intervention, or the procurement of a specific part is required.

AKRONE makes every effort to process the request as quickly as possible given the nature of the intervention and the availability of necessary components.

This nine to fifteen week period does not apply to conformity actions carried out under the legal warranty of conformity.

When a request falls under the legal warranty of conformity, the conformity action takes place within a reasonable period not exceeding thirty days following the consumer's request, free of charge and without major inconvenience to them.

5.3 Immobilization

When a repair covered by a legal warranty or by the commercial warranty results in the immobilization of the watch, any period of immobilization suspends the remaining warranty period until the delivery of the repaired Product.

This period starts from the consumer's request for intervention or the availability of the watch for repair or replacement, when this second starting point is more favorable to the consumer.

The warranty period is also suspended when the consumer and the guarantor enter into negotiations for an amicable settlement.

6. RESALE AND TRANSFER OF OWNERSHIP

AKRONE is not a party to transactions concluded between the owner of an AKRONE watch and its buyer on the second-hand market and does not assume the specific obligations of the seller in such a transaction.

The resale of a watch does not create any new warranty, does not reset any period to zero, and does not, in itself, extend the duration of the existing warranty.

When a watch effectively benefited from the AKRONE commercial warranty and is transferred between consumers, whether for a fee or free of charge, the new owner benefits from the remaining rights attached to this warranty, under the same conditions, limits, and exclusions as those applicable to the original owner.

Conversely, the resale of a prototype, a loaned watch, a press or test copy, a donation, or any other Product for which no AKRONE commercial warranty had been granted at its initial delivery does not create any AKRONE commercial warranty.

Personal benefits distinct from the warranty attached to the Product, such as discount codes, promotional offers, loyalty benefits, or other privileges personally granted to the first beneficiary, are not transferred upon resale, unless otherwise committed by AKRONE.

7. FRAUD, DIAGNOSIS AND UNCOVERED CLAIMS

AKRONE may refuse coverage under the commercial warranty when a claim is based on obvious fraud, including:

  • deliberate falsification of an invoice, warranty certificate, or proof of purchase;
  • identity theft;
  • falsification of the serial number or elements identifying the watch;
  • deliberate presentation of false information related to the Product or the alleged damage.

Such a refusal concerns the commercial warranty and does not deprive a person of a mandatory legal right they could otherwise validly benefit from.

If, after examination, the alleged defect is covered by neither the commercial warranty nor a statutory warranty, AKRONE may offer a diagnosis, a quote, or a paid repair.

If a diagnosis or quote is likely to be charged for, its principle and amount will be communicated to the customer before the relevant costs are incurred.

No paid repair will be carried out without the express consent of the customer.

8. RELATION WITH STATUTORY WARRANTIES

The AKRONE commercial warranty is an additional commitment to the rights provided by law.

It cannot limit, exclude, or condition the exercise of the legal guarantee of conformity or the warranty against hidden defects when these are applicable.

If an AKRONE commitment or advertisement applicable at the time of acquisition provided for more favourable commercial warranty conditions, these conditions remain applicable under the terms provided by the regulations.
